Terms of Service

1. Acceptance of Terms

By accessing or using The Signal Engine ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and The Signal Engine. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Your use of this Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

2. Eligibility

To use The Signal Engine, you must:

• Be at least 18 years of age (or the age of legal majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Service under applicable laws
• Be legally permitted to engage in cryptocurrency trading in your jurisdiction

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone who does not meet these criteria.

3. Description of Service

The Signal Engine provides:

• Algorithmic trading signals for cryptocurrency markets
• Technical analysis data and indicators
• Real-time notifications via Discord, Telegram, or API
• Historical signal performance data

AutoTrader Products

We also offer automated trading solutions that execute signals on your behalf:

• AutoTrader Lite: A streamlined automated trading app with pre-configured risk profiles. Users select from fixed Conservative or Aggressive profiles with locked settings designed for simplicity and safety.
• AutoTrader Pro: A fully customizable trading solution with complete flexibility. Create your own presets, adjust all parameters, configure advanced risk management, and tailor every aspect of your Solana trading strategy to your exact specifications.

Important: AutoTrader products execute trades based on your configured settings but remain non-custodial. You maintain full control of your wallet and private keys at all times. You authorize each transaction, and we never have access to withdraw your funds.

Whether using signals manually or through AutoTrader, the Service is 100% non-custodial. We do not hold your funds or have access to your wallets.

4. No Financial Advice

You acknowledge that:

• All trading decisions are made solely by you
• You should consult with qualified financial advisors before making investment decisions
• Past performance of signals does not guarantee future results
• The creator of this Service uses the same signals for personal trading, but this does not imply any guarantee of success

5. Risk Acknowledgment

By using the Service, you explicitly acknowledge and accept that:

• Cryptocurrency trading is highly speculative and involves substantial risk of loss
• You may lose some or all of your invested capital
• Cryptocurrency markets are volatile and can move against you rapidly
• Technical analysis and algorithmic signals are not infallible
• Market conditions can change without warning
• Liquidity issues, smart contract bugs, and exchange failures can result in total loss
• You should only trade with funds you can afford to lose entirely

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SIGNAL ENGINE AND ITS OPERATORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any losses, damages, or costs arising from your use of the Service
• Any trading losses, regardless of whether you followed our signals
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Service interruptions, delays, or errors
• Actions of third parties, including exchanges, wallets, or blockchain networks

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

7. No Guarantees

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any signals or data
• Warranties regarding the profitability or success rate of any trading strategy

8. User Responsibilities

You agree to:

• Conduct your own research before making any trading decisions
• Maintain the security of your account credentials
• Not share your API keys or subscription access with others
• Comply with all applicable laws and regulations in your jurisdiction
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to reverse-engineer, copy, or redistribute the Service

9. Subscription and Payments

• Subscriptions are billed monthly in cryptocurrency (SOL, USDC) or via card payment
• You may cancel your subscription at any time; access continues until the end of your current billing period
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in suspension or termination of access

Refund Policy

We strongly encourage you to:

• Review our public signal history on the Live Signals page before subscribing
• Backtest the signals yourself: observe the delayed public feed for several days to validate performance
• Read the documentation to understand how signals are generated and what to expect
• Start with capital you can afford to lose: never trade with money you cannot risk

By subscribing, you confirm that you have done your own research and accept that:

• This service provides informational and educational content only
• Signals are not financial advice and do not guarantee profits
• Past performance does not predict future results
• You are solely responsible for your trading decisions

Refund Requests

If you believe you have exceptional circumstances, you may contact us at [email protected] with your request and reason. However, please note:

• We reserve the right to deny any refund request at our sole discretion
• Requests based on trading losses will not be considered. Signals are informational tools, not guarantees
• Failure to profit from signals does not constitute grounds for a refund
• Technical issues on our end (extended outages, service failures) may be considered on a case-by-case basis

10. Intellectual Property

All content, algorithms, signals, data, and materials provided through the Service are the intellectual property of The Signal Engine. You may not copy, reproduce, distribute, or create derivative works without explicit written permission.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service ceases immediately.

12. Indemnification

You agree to indemnify and hold harmless The Signal Engine and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these Terms shall be resolved through binding arbitration in Thailand, conducted in English, in accordance with the Arbitration Rules of the Thailand Arbitration Center (THAC).

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
